Basic Information on the Permanent Arbitration Court of the Slovak Banking Association
(Chamber for Deciding Disputes on Payment Services)
The Permanent Arbitration Court of the Slovak Banking Association was established on 1 July 2003.
The Permanent Arbitration Court of the Slovak Banking Association established under the legislation on arbitration and Act No. 510/2002 Coll. on Payment System and on Amendments to Certain Acts, as amended, is considered as permanent court of arbitration within the meaning of the Act No. 492/2009 on Payment Services and on Amendments to Certain Acts.
Establishment of the Permanent Arbitration Court of the Slovak Banking Association created the institutional basis for creation of a mechanism for the suitable and efficient out-of-court resolution of disputes in the field of payment services and electronic money (hereinafter "payment services").
The Permanent Arbitration Court of the Slovak Banking Association - the Chamber for Deciding Disputes on Payment Services (hereinafter "the Permanent Arbitration Court") is competent to decide on disputes regarding payment services arisen between payment service providers and payment service users.
Payment service providers are obliged to offer their payment service users an irrevocable proposal to conclude an arbitration agreement which is incorporated in the framework contract (contract on payment services). The payment service user has a choice whether to accept the proposal to conclude the arbitration agreement. If the payment service user does not accept the proposal to conclude the arbitration agreement, any disputes between the payment service provider and payment service user shall be resolved through a procedure in according with specific regulations, mainly before a general court.
Disputes concerning the payment services are decided by arbitrators listed in the Register of Arbitrators held for the Permanent Arbitration Court. Arbitrators decide individual disputes as a rule in senates composed of at least three arbitrators.
In performing the function of arbitrator, arbitrator is independent, impartial and never acts on behalf of the parties involved in the arbitration.
Proceedings before the Permanent Arbitration Court are free of charge.
